UPDATE OF FLEISCHMANNS ZONING LAW SET TO BEGIN

The Zoning Law Update Process:

The Village Board recently appointed a Zoning Law Review Committee to spearhead an update of the Village's 1997 Zoning Law.  The existing Zoning Law will be amended to ensure that is it is consistent with the Village's 2009 Comprehensive Plan and to provide better protection of the health, safety and welfare of the community.  

The Committee will meet monthly to discuss the Village's Zoning Law and to recommend needed revisions. The Committee will then forward recommended revisions to the Village Board for their consideration.   Once the Village Board accepts the proposed revisions, it must then prepare State Environmental Quality Review Act (SEQRA) documentation and refer the proposed Zoning Law and SEQRA documentation to the Delaware County Planning Board allowing thirty (3) days for their review.   The Village Board must also hold at least one (1) public hearing prior to adopting the Zoning Law revisions.  We anticipate that this process will take about eight (8) months.

Concurrently, the Committee will provide input into the development of a set of Design Guidelines for the Main Street Business District.   A tentative schedule is provided below.

The Comprehensive Plan Process:

The first public workshop, that will included a Community Character Survey™ conducted by Planit Main Street, Inc., was held at the Skene Memorial Library on May 9, 2009 from 2:00 PM to 4:00 PM.

The Fleischmanns Comprehensive Plan Committee met on the fourth Thursday of each month at The Skene Memorial Library during the process of completing the Comprehensive Plan.  The first draft of the Comprehensive Plan was completed in late September and copies were made available for public review at the Skene Memorial Library and this webpage.   A Public Hearing was then held on the draft Comprehensive Plan on October 22, 2009 at the Skene Memorial Library.

Following the first Public Hearing, revisions were made to the draft Comprehensive Plan and required State Environmental Quality Review Act (SEQRA) environmental review documents were completed.  These materials were then referred to the Involved Agencies for review and recommendations.  Comments received from the Involved Agencies were then incorporated into the final Comprehensive Plan.  

The second Public Hearing on the Comprehensive Plan was held on December 14, 2009 at the Skene Memorial Library. Following the close of the public hearing, the Village Board passed a resolution to adopt the final Comprehensive Plan.  

Any recommended zoning text and map amendments will follow thereafter. The Village Board will be appointing a Zoning Review Committee to oversee the process of revising its Zoning Law in 2010.

Background:

The Village of Fleichsmanns Zoning Law was adopted in 1997. Since that time, the Village Board participated in several targeted planning studies including 1) Village of Fleischmanns Downtown Assessment (conducted in July of 2002 by the Catskill Center) and 2) Strategy for Revitalizing Fleischmanns (completed in May of 2007 by SUNY New Paltz in conjunction with the M-ARK Project). In 2008, the Village Board secured funding through the Catskill Watershed Corporation to undertake the completion of a Comprehensive Plan. The Village Board feels that a new Comprehensive Plan is necessary to guide/stimulate future development and/or redevelopment in a manner that preserves the historic character of the Village. The new Comprehensive Plan will address such issues as natural resource protection; parkland and open space; downtown revitalization; economic development; and historic preservation. It will also form the basis for future land use regulations and subsequent zoning revisions that may be necessary to implement the recommendations contained within the Comprehensive Plan. The development of the new Comprehensive Plan will include a strong public participation process and is an opportunity for the entire community to come together to create a set of land use policies to guide growth and redevelopment within the Village of Fleischmanns.

Comprehensive Plan Committee:

The Village Board appointed a Comprehensive Plan Committee to lead the public participation process and prepare the Village's new Comprehensive Plan.  In November of 2008, the Village Board retained the services of Planit Main Street, Inc. to work with the Committee in the development of its new Comprehensive Plan.  The Comprehensive Plan Committee completed the first draft of the Comprehensive Plan in late September of 2009.

How Do I Get Involved?

The Comprehensive Plan Committee will be meeting monthly at The Skene Memorial Library to work on the creation of the Comprehensive Plan. These meetings are open to the public. You can also contribute to the effort by attending public workshops that will be held periodically by the Committee to gather input from the public. Public participation is a vital component of a successful Comprehensive Plan and your input is welcome.

What Is A Comprehensive Plan?

  • Expression of a community's goals for the future and recommendations for achieving those goals.
  • Outline for orderly growth, providing continued guidance for decision-making.
  • Document which focuses on immediate and long-range protection, enhancement, growth and development.

The new Comprehensive Plan can be used to answer a variety of questions about the Village of Fleischmanns. These include: What should the Village look like in the future?

  • Where business and industrial land uses should be permitted?
  • What can we do to expand our parks & open space?
  • What programs can be put in place to encourage historic preservation?
  • How can we protect our natural resources?
  • Does our zoning and related regulations need to be revised?

Why Is A New Comprehensive Plan Needed?

  • All land use regulations (i.e. zoning, design guidelines, subdivision regulations) must be in accordance with a Comprehensive Plan.

What Is The Relationship Between The Comprehensive Plan And Zoning?

  • The Comprehensive Plan establishes the objectives that the community wants to achieve.
  • The Zoning Law sets forth the regulations designed to achieve the objectives of the Plan.
